Terms of Use and Privacy Policy

1. Acceptance of the terms of use

Any person connecting to the Site is hereinafter referred to as the "User".

By accessing the Site and/or using the services offered by the Site, the User agrees to comply with these terms of use (the "Terms"), which they declare and acknowledge having read in full.

The Terms govern the relationship between the Site and the User, the Site being accessible from various devices (computer, tablet, smartphone, etc.).

EVERSIDE may modify the Terms at any time and unilaterally. These modifications shall be binding on the User as soon as they are published on the Site, which the User is responsible for consulting regularly in order to be aware of them. The User is deemed to accept the latest version each time they connect to the Site.

In the event of non-compliance with the Terms by the User, EVERSIDE may suspend the services offered by the Site without notice and/or deny the User access to said services.

It is specified that, in the relationship between EVERSIDE and the User, the Terms govern their entire contractual relationship and apply to the exclusion of any other agreement.

2. Description of the services offered by the site

The Site is a platform for sending electronic greeting cards for companies that are clients of Everside (the "Clients"), which have a dedicated space, in their own branding, on which they insert their own electronic greeting cards.

Use of the Site in accordance with the Terms is free of charge for the User. The User may use the site to prepare, schedule and send their greetings by email.

3. Access to the site

The Site is accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond EVERSIDE's control, subject to any breakdowns and maintenance operations necessary for the proper functioning of the Site and its services.

To access the Client's dedicated space, the User must enter an access code that has been previously communicated to them. It is the User's responsibility not to disclose this access code to any person not authorized to use the service.

In the event of loss or theft of the access code for the dedicated space, the User is responsible for any harmful consequences thereof and must contact EVERSIDE as soon as possible at the following email address: [email protected] to have the code changed. EVERSIDE cannot be held liable if the User fails to follow this procedure or delays in contacting EVERSIDE.

4. Intellectual property

All content on the Site (photographs, visual identity, layout, texts, logos, trademarks, software, etc.) is protected by the French Intellectual Property Code and may not be reproduced, represented, adapted or used without the express prior consent of EVERSIDE and/or the holders of the rights to said content.

Any unauthorized use of said content shall constitute an act of infringement liable to result in civil and/or criminal proceedings.
