Terms of Use

1. Acceptance of the terms of use

Any person who signs in to an Evercard platform (the "Site") is referred to below as the "User".

By accessing the Site and using the services offered, the User undertakes to comply with these terms of use (the "Terms"), which they declare to have read in full.

The Terms govern the relationship between EVERSIDE and the User, the Site being accessible from various devices (computer, tablet, smartphone).

EVERSIDE may amend the Terms at any time. Amendments are binding on the User as soon as they are published at https://www.evercard.digital/legal/cgu, which the User is responsible for consulting regularly. The User is deemed to accept the latest version at each new sign-in.

In case of non-compliance with the Terms, EVERSIDE may suspend the User's access to the Site without notice.

2. Description of the service

The Site is an e-greeting card sending platform made available to EVERSIDE's client companies (the "Clients"), each of which has a dedicated space, in its colours, on which it publishes its own greeting cards.

Use of the Site is free for the User. They can prepare, schedule and send greetings by email, publish greeting pages and track their sendings.

3. Access to the Site and User account

The Site is accessible 24 hours a day, 7 days a week, except in case of force majeure or events beyond EVERSIDE's control, and subject to outages and maintenance operations required for its proper functioning.

The User signs in with their work email address, through a sign-in link sent to that address, their Google account or, if the Client has set it up, their company directory. At their first sign-in, they enter the season access code provided by the Client, or accept the invitation received by email. An account is then created in their name; they enter their first and last name and may add a picture.

The access code and sign-in links are personal. The User shall not share them with anyone not authorised to use the service. In case of doubt about the use of their account, they inform EVERSIDE without delay through the support chat built into the Site or the contact form https://www.evercard.digital/contact.

The User may request the deletion of their account at any time, from their Client or from EVERSIDE.

4. Sendings, recipients and content

The User only sends cards to people with whom they or their Client have a professional relationship, and in compliance with the rules applicable to email prospecting. They are responsible for the content they write or import: they refrain from any unlawful, abusive or discriminatory content or content infringing third-party rights.

Google and Microsoft 365 address books that the User chooses to import are read at import time and never kept; only the recipients they select are stored.

5. Public greeting pages

When the Client has enabled this feature, the User may publish a greeting page accessible by a link, which they share freely. This page shows their name, their picture if they added one, the name of their company or entity and the message they wrote. It is visible to anyone who has the link as long as they keep it online. They can take it offline or delete it at any time. The Client may also withdraw a page published in the name of its company.

6. Recipients' replies

Card recipients or visitors of a greeting page may send a reply to the User. This reply is forwarded to them by email and remains available in their space. Replies are limited in number per recipient and protected against automated submissions.

7. Intellectual property

All content of the Site (visual identity, layouts, texts, logos, trademarks, software) is protected by the French Intellectual Property Code and may not be reproduced, represented, adapted or used without the express prior consent of EVERSIDE or the rights holders.

Cards, visuals and messages published by the Client and the User remain the property of their authors. EVERSIDE does not reuse them.

8. Personal data

The User's data and the recipients' data are processed as described in the privacy policy. Recipients' personal data is purged at the end of each greeting season.
